How Does Child Support Work in Apple Valley and the High Desert?
The short answer: Child support in Apple Valley is calculated with the same statewide guideline formula used in every California county, set out in Family Code section 4055. The formula turns on each parent's income and the share of time each parent has the children. Family law cases from Apple Valley, Victorville, Hesperia, Adelanto, and Barstow are generally heard at the Victorville, Barstow, or Joshua Tree courthouses as the San Bernardino Superior Court assigns them. This guide from our child support attorneys explains how a High Desert child support case starts, what the judge looks at, and how to change an order later.
Where Apple Valley Child Support Cases Are Heard
Courthouse routing. Most family law filings from Apple Valley, Victorville, and Hesperia are assigned to the Victorville courthouse, while cases from the Barstow area and the Morongo Basin may be assigned to the Barstow or Joshua Tree courthouses. Assignments change, so confirm the current rules and filing cutoffs on the San Bernardino Superior Court website before you file. Our guide to the Victorville courthouse covers the building and the local process in more detail.
How California Calculates Child Support
The guideline is mandatory. Family Code section 4055 contains the algebraic formula, and Family Code section 4053 lists the principles behind it, including that a parent's first obligation is to support the children according to the parent's circumstances and station in life. In In re Marriage of Cheriton, the Court of Appeal confirmed the guideline amount is presumptively correct and a judge may depart from it only on the findings required by Family Code section 4057. Parents who share time equally still pay support when incomes differ, as our guide to child support with 50/50 custody explains.
What counts as income. Family Code section 4058 defines income broadly: wages, overtime, commissions, self-employment earnings, rental income, disability benefits, and military pay and allowances for parents stationed at Fort Irwin or the Marine Corps base at Twentynine Palms. Family Code section 4059 lists the deductions, such as taxes, mandatory union dues, and health insurance premiums. A parent who is unemployed or underemployed by choice can have income attributed under the rules in our guide to imputed income.
How to Start a Child Support Case in the High Desert
Two paths. (1) The San Bernardino County Department of Child Support Services can open a case at no charge under Family Code section 17400 and will establish, collect, and enforce support, though it does not represent either parent. (2) A parent can file a Request for Order on form FL-300 with an Income and Expense Declaration on form FL-150 (or the simplified FL-155 when eligible) in an existing divorce, parentage, or custody case. Parents who were never married first need a parentage judgment, covered in our guide to unmarried fathers' rights. Filing fees may be waived on form FW-001.
Service and timing. The request and a blank Responsive Declaration on form FL-320 must be served at least 16 court days before the hearing under Code of Civil Procedure section 1005, with extra days for mail service. Under Family Code section 4009 an original support order may be made retroactive to the date of filing, and Family Code section 3653 applies the same rule to modifications, so the filing date, not the hearing date, usually controls when support begins. Do not wait to file while you negotiate.
What Happens at the Victorville Hearing
The judge works from the paperwork. The court reviews both parents' FL-150 forms, recent pay stubs, tax returns, and the custody timeshare, then runs the guideline calculation. Under Family Code section 217 either parent may ask to give live testimony on disputed facts such as cash income or the real parenting schedule. The order is written on form FL-342, and a wage assignment under Family Code section 5230 on form FL-195 is issued unless the parents agree on another payment method. Our guide to child support hearings walks through a typical hearing day.
Add-Ons, Health Insurance, and Travel Costs
Beyond the base amount. Family Code section 4062 requires the court to add childcare related to work or training and the children's uninsured health costs, and allows additional amounts for educational needs and travel for visitation. Family Code section 4061 splits those add-ons equally unless a parent asks for an allocation based on net disposable income. Family Code section 3751 requires an order for health insurance when it is available at reasonable cost. Travel costs matter in the High Desert, where one parent often commutes to Los Angeles, Rancho Cucamonga, or Las Vegas for work.
Can Parents Agree to a Different Amount?
Yes, with findings. Family Code section 4065 allows parents to stipulate to an amount below guideline if they are informed of their rights, no one is receiving public assistance, and the court finds the agreement is in the children's best interest. The agreement is usually written on form FL-350 and signed by the judge. Many Apple Valley parents reach that agreement through mediation or with limited-scope help drafting the stipulation, which costs far less than a contested hearing.
Changing or Enforcing a High Desert Support Order
Modification. Family Code section 3651 lets either parent ask to change support when circumstances change, such as a layoff, a new job, a change in the parenting schedule, or a child reaching adulthood. The request is filed on form FL-300 with a new FL-150. Because Family Code section 3653 limits retroactivity to the filing date, a parent who loses a job should file immediately rather than letting arrears build. A change in the custody schedule often changes support too, as our guide to modifying a custody order explains.
Enforcement. Unpaid support accrues interest and does not go away. The wage assignment under Family Code section 5230 reaches most employers, DCSS can intercept tax refunds and suspend licenses, and a parent may file for contempt, which we cover in our guide to contempt for unpaid child support. Options for old balances are discussed in our guide to child support arrears.
Common Mistakes High Desert Parents Make
Avoid these. (1) Relying on a handshake agreement that the court never signed, which cannot be enforced and does not stop guideline support from accruing. (2) Understating or overstating the timeshare, which the other parent will challenge with school and exchange records. (3) Waiting months after a job loss to file, since relief cannot reach back before the filing date. (4) Skipping the FL-150 attachments, which leads to a continuance and a wasted trip to Victorville. A flat-fee or limited-scope attorney can prepare the packet correctly the first time.
Frequently Asked Questions
Which courthouse handles child support for Apple Valley?
Usually Victorville. Family law cases from Apple Valley, Victorville, Hesperia, and Adelanto are generally assigned to the Victorville courthouse, while Barstow and Morongo Basin cases may go to the Barstow or Joshua Tree courthouses. Confirm the current assignment and any filing cutoffs on the San Bernardino Superior Court website, because assignments change.
How long does a child support case take in Victorville?
Usually a few months. A Request for Order on form FL-300 is set for hearing after the Code of Civil Procedure section 1005 notice period, and the first available date depends on the court's calendar. DCSS cases follow their own timeline. Because Family Code section 4009 allows the order to be retroactive to the filing date, the wait does not cost the requesting parent support.
Does child support end when my child turns 18?
Not always. Family Code section 3901 continues support for an unmarried child who is 18, still in high school full time, and not self-supporting, until the child graduates or turns 19, whichever comes first. Parents may agree in writing to support beyond that, and support for an adult child who cannot be self-supporting because of a disability is governed by separate rules.
Can I lower support if I lost my job at Fort Irwin or in Victorville?
Yes, by filing. Family Code section 3651 allows a modification for a material change in circumstances, and an involuntary job loss usually qualifies. File form FL-300 with a current FL-150 right away, because Family Code section 3653 does not allow the court to reduce support for any period before the filing date, and continue paying what you can in the meantime.
