How to File for Divorce in San Bernardino County: A Step-by-Step Guide

Step 1: Confirm Residency Requirements

Before filing, one spouse must have lived in California for at least six months, and in San Bernardino County for at least three months. If you or your spouse do not meet these requirements, you may need to wait or file in another county.

Step 2: Complete the Required Forms

To initiate your divorce, you’ll need to complete several forms:

  • Petition for Dissolution of Marriage (FL-100)

  • Summons (FL-110)

  • Declaration Under Uniform Child Custody Jurisdiction and Enforcement Act (FL-105) if minor children are involved

  • Property Declaration (FL-160) for separate and community property

If you omit the Certificate of Assignment, your petition will likely be rejected by the court clerk.

Step 3: File Your Petition

Take your completed forms to the San Bernardino Family Law Division, located at:

If you're filing at a branch court like Victorville, Rancho Cucamonga, or Joshua Tree, your Certificate of Assignment will determine where your case is assigned.

Step 4: Serve the Other Party

After filing, you must serve your spouse with the divorce papers through a non-party adult. The Proof of Service (FL-115) must be filed afterward. Improper service can delay your case or cause issues with judgment entry.

Step 5: Disclose Financial Information

Each party is required to exchange Preliminary Declarations of Disclosure, including income, assets, debts, and expenses. This ensures fair and complete information is available before resolving property division or support.
